In a letter to BOE commissioners, the request for the proposals\u2019 rejection highlights that <a href=\"https:\/\/codes.findlaw.com\/ny\/municipal-home-rule-law\/mhr-sect-36\/#:~:text=In%20such%20case%20the%20charter%20commission%20shall%20prescribe%20the%20form%20of%20the%20questions%20to%20be%20submitted%2C%20which%20shall%20be%20such%20as%20clearly%20to%20indicate%20the%20effect%20of%20their%20approval.\" target=\"_blank\" rel=\"noreferrer noopener\">New York State Municipal Home Rule Law<\/a> requires that referenda \u201cclearly \u2026 indicate the effect of their approval.\u201d However, the language for these three proposals fails to disclose that they eliminate the voting authority of the City Council on a range of public land use decisions, which is currently the only vote by democratically elected representatives within the process. They would shift authority for land use decisions from the democratically elected City Council to unelected appointees, the majority of whom are chosen by the mayor. Yet, neither the proposals\u2019 questions nor their associated abstracts that voters will encounter on their election ballots clearly state these major changes.&nbsp;<\/p>\n<p>The misleading nature of Mayor Adams\u2019 ballot proposal language leaves voters without a clear understanding of the implications of their decisions and therefore, fails to meet statutory requirements and a basic commitment to democracy that respects voters\u2019 informed consent and will.&nbsp;<\/p>\n<p>\u201cWhen New York City voters weigh in on ballot questions this November, they deserve to know the impact of their decision in clear and honest terms,\u201d said&nbsp;<strong>Speaker Adrienne Adams<\/strong>. \u201cMayor Adams\u2019 ballot questions 2, 3, and 4 attempt to mislead voters by hiding their real impact of eliminating the public\u2019s power over land use decisions that allow new development. This major change to remove the only democratically elected entity with voting power in the land use process undermines New Yorkers\u2019 ability to secure more affordable housing and investments for their neighborhoods. The Board of Elections should protect voters and voting rights by rejecting Mayor Adams\u2019 ballot proposals 2, 3, and 4 for intentionally concealing their impact from voters at the ballot.\u201d&nbsp;<\/p>\n<p>The full letter can be accessed <a href=\"https:\/\/council.nyc.gov\/press\/wp-content\/uploads\/sites\/56\/2025\/09\/Letter-to-BOE-re-CRC-Ballot-Proposals.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here.<\/a>&nbsp;<\/p>\n<p><strong>The letter states<\/strong>: \u201cWhen the City Board of Elections makes its upcoming Election Law Section 4-114 determination of the November 2025 ballot, it must reject these three ballot questions based on the law. In particular, the three questions fail to inform voters that the ballot proposals will <em>completely eliminate<\/em> the City Council\u2019s existing authority on behalf of the public to approve or modify a wide range of land use proposals.\u201d&nbsp;<\/p>\n<p>\u201cQuestions 2, 3, and 4 must be rejected for placement on the November ballot because their primary impact is being hidden from voters, undermining the franchise,\u201d <strong>the letter continues<\/strong>. \u201cFailing to disclose this information is no small omission. It is not fair to ask New Yorkers to vote on such major changes to a significant democratic process without ever actually telling them what they are voting to change in accurate and clear terms. The Board of Elections has an essential responsibility and role in ensuring that voters are not misled here.\u201d&nbsp;<\/p>\n<p><strong>The letter indicates<\/strong>: \u201cNew York Courts have upheld Board of Election Commissioners\u2019 ability to exercise that power where proposed ballot questions are unclear about a crucial aspect of a proposed ballot initiative. <em>Lenihan v. Blackwell<\/em>, 209 A.D.2d 1048, 1049 (4th Dep\u2019t 1994).\u201d\u00a0<\/p>\n<p>For 35 years, New Yorkers have relied on the City Council\u2019s role as the only democratically elected body with the power to vote on local land use decisions. This authority ensures that communities have a voice in shaping development in their neighborhoods, and it has been leveraged to win deeper affordability in new housing and secure investments that strengthen neighborhoods across the city, including for schools, childcare centers, parks, open space, public transit, and core infrastructure needs. These potential ballot proposals would remove the democratically elected Council from the process and undermine its work on behalf of the public to secure critical benefits from the City and developers for neighborhoods as part of approved development. The attempted refusal to inform New York City voters about the choice before them is an intentional deception and shameful disregard of democracy by Mayor Adams and his Commission, which must be rejected.\u00a0<\/p>\n<p>\u201cDeceiving voters at the ballot box is undemocratic and harmful to all New Yorkers,\u201d said&nbsp;<strong>Deputy Speaker Diana Ayala<\/strong>. \u201cMayor Adams\u2019 ballot proposals 2, 3, and 4 would make drastic changes that undermine neighborhoods\u2019 power to win more affordable housing and community benefits from developers and the City. Yet, what is being proposed to tell voters hides this fundamental change to eliminate public power and accountability. The Board of Elections cannot allow this deception of voters and their voting rights.\u201d&nbsp;<\/p>\n<p>\u201cMayor Adams\u2019 ballot proposals 2, 3, and 4 undermine our communities\u2019 ability to secure more affordable housing and essential community benefits, while deliberately obscuring their true consequences from voters,\u201d said <strong>Majority Leader Amanda Farias<\/strong>. \u201cThis is a clear attempt to manipulate the approval process and strip away the power and voice of New Yorkers in shaping their neighborhoods. Voters have the right to fully understand what they are being asked to approve, especially when their choices will have lasting effects on the future of their communities. We urge the Board of Elections to honor state law and reject these misleading ballot questions from Mayor Adams.\u201d\u00a0<\/p>\n<p>\u201cNew Yorkers deserve honesty, not bait-and-switch ballot language designed to mislead people into voting against their own best interests,\u201d said <strong>Minority Leader Joann Ariola.<\/strong>\u00a0\u201cThese proposals would strip away the voices of communities in every borough and block the Council from standing up for the people who elected us.
