{"id":2084,"date":"2021-04-24T17:27:06","date_gmt":"2021-04-24T17:27:06","guid":{"rendered":"https:\/\/council.nyc.gov\/press\/?p=2084"},"modified":"2021-04-24T17:27:06","modified_gmt":"2021-04-24T17:27:06","slug":"speaker-johnson-council-member-moya-public-advocate-williams-and-state-senator-benjamin-introduce-billsdesigned-to-weed-out-bad-cops","status":"publish","type":"post","link":"https:\/\/council.nyc.gov\/press\/2021\/04\/24\/2084\/","title":{"rendered":"Speaker Johnson, Council Member Moya, Public Advocate Williams and State Senator Benjamin Introduce BillsDesigned to Weed out Bad Cops"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><em>City and state legislation would disqualify police guilty of misconduct in other departments from getting hired in New York<\/em><\/p>\n<p class=\"wp-block-paragraph\"><strong>City Hall, NY\u00a0\u2013<\/strong>\u00a0As part of the Council\u2019s efforts to increase police accountability\u00a0and reimagine\u00a0public safety, Speaker Corey Johnson, Council Member Francisco Moya, and Public Advocate Jumaane Williams are introducing a bill that will ban the city from hiring police officers\u00a0from other jurisdictions\u00a0who\u00a0were\u00a0fired for misconduct or resigned\u00a0while being investigated for misconduct. The\u00a0bill requires\u00a0the Department of Citywide Administrative Services\u00a0\u2013 which set qualifications for civil service jobs \u2013 to add a line in the hiring code that automatically disqualifies these officers\u00a0when they apply for the NYPD.\u00a0\u00a0\u00a0There are already several disqualifications from becoming an NYPD officers, including domestic violence misdemeanors, dishonorable discharge from the military and felony convictions.\u00a0While transfers to the NYPD are not common, the goal of this legislation is to make sure that no one with\u00a0a\u00a0history of\u00a0misconduct\u00a0finds\u00a0their way into the city\u2019s police force.\u00a0\u00a0\u00a0State Senator Brian Benjamin will introduce a\u00a0companion\u00a0bill in the State Senate, barring police\u00a0departments\u00a0in the state\u00a0from hiring\u00a0cops\u00a0from other jurisdictions\u00a0who were fired or resigned pending a misconduct investigation.\u00a0\u00a0\u00a0Officers who are fired\u00a0from one department only to get hired by another,\u00a0known as wandering officers, are more likely to receive misconduct complaints and get fired again compared to other officers, according to a\u00a02020 report in the\u00a0Yale Law Journal.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u00a0\u201cAll it takes is one bad cop to make a fatal mistake, shatter a family and destroy\u00a0the trust people have in\u00a0all police.\u00a0Sadly, we&#8217;ve seen too many police\u00a0misconduct\u00a0cases across the country, and many times these\u00a0so-called \u2018wandering\u00a0officers\u2019\u00a0land in other departments. We\u00a0don\u2019t want them in the NYPD, and\u00a0we\u00a0must do everything we can do to prevent them\u00a0from\u00a0working\u00a0as officers in\u00a0our city,\u201d\u00a0<strong>said Speaker Corey\u00a0Johnson<\/strong>.\u00a0\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cEvery step we can take towards dismantling systemic racism is an action towards meaningful police reform. The bill I\u2019m introducing is a step to keep the bad apples from multiplying\u2014if an officer is let go because of disciplinary issues, regardless of jurisdiction, they will be ineligible for NYPD service. This is about protecting Black and Brown lives from police officers who have had a history of misconduct. With this bill, New York City can be an example of vigorous and positive action so Black lives are no longer in danger,\u201d said\u00a0<strong>Council Member Francisco Moya<\/strong>.\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">\u201cWe\u00a0need\u00a0to\u00a0restore\u00a0and\u00a0protect\u00a0the trust\u00a0between\u00a0our\u00a0communities\u00a0and the\u00a0individuals\u00a0sworn\u00a0to\u00a0protect\u00a0them. We can\u2019t do that if we have\u00a0people\u00a0serving\u00a0as police\u00a0officers\u00a0who\u00a0other\u00a0cities\u00a0or states have\u00a0determined\u00a0are not fit for\u00a0duty,\u201d\u202f\u202fsaid\u00a0<strong>Senator\u00a0Brian Benjamin<\/strong>. \u201cOnce we\u00a0enact\u00a0this bill\u00a0into\u00a0law\u00a0on the city and state\u00a0level, we can be sure that we are not\u00a0empowering\u00a0people\u00a0who have a\u00a0history\u00a0of\u00a0abusing\u00a0their\u00a0positions. This bill\u00a0will\u00a0increase\u00a0transparency\u00a0around\u00a0policing\u00a0and\u00a0protect\u00a0the public from abusive\u00a0officers,\u00a0increasing\u00a0public\u00a0safety\u00a0for all.\u201d\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">&#8220;Right\u00a0now, an\u00a0officer\u00a0could\u00a0be\u00a0fired\u00a0in Minnesota for\u00a0misconduct\u00a0and\u00a0find\u00a0a job\u00a0waiting\u00a0for\u00a0them\u00a0down at 1 Police Plaza.\u00a0Kim\u00a0Potter,\u00a0who\u00a0killed\u00a0Daunte\u00a0Wright,\u00a0could\u00a0be\u00a0submitting\u00a0her\u00a0resume,\u201d\u00a0said\u00a0<strong>Public\u00a0Advocate Jumaane\u00a0Williams<\/strong>.\u00a0&#8220;That\u2019s\u00a0nonsensical,\u00a0and\u00a0the\u00a0legislation\u00a0we\u00a0announced\u00a0today\u00a0will\u00a0close\u00a0this\u00a0loophole\u00a0to\u00a0accountability\u00a0by\u00a0adding\u00a0to\u00a0the\u00a0list\u00a0of\u00a0prohibiting\u00a0factors\u00a0for\u00a0officers,\u00a0preventing\u00a0the\u00a0hiring\u00a0of\u00a0police\u00a0from\u00a0other\u00a0jurisdictions\u00a0who\u00a0were\u00a0fired\u00a0or\u00a0resigned\u00a0because\u00a0of\u00a0misconduct.
