Some of these summonses gave offenders a <strong>permanent<\/strong> criminal record, and missing one court date led to an arrest warrant.<\/p>\n<p>These penalties did not fit the crime. While the offenses remain illegal, the Council has passed a series of laws to solve this problem.<\/p>\n<p>This new legislation sends over 100,000 of these cases to civil court rather than criminal court, saving almost 10,000 people per year from having a permanent criminal record and avoiding over 50,000 warrants every year. That meant that many people were required to take a day off work every year to go to court. And if someone missed their court date, they had an open warrant.<\/p>\n<p>There are 1.5 million open summons warrants in New York. If you have an open warrant and get stopped by the police, you will be detained for approximately 24 hours waiting to go before a judge.<\/p>\n<\/div>\n<div class=\"columns large-7\">\n<div class=\"flex-video widescreen\"><iframe loading=\"lazy\" src=\"https:\/\/newyorkcitycouncil.github.io\/datavis\/legislation\/criminal_summons_types_2015\/\" name=\"bar-chart\" width=\"300\" height=\"150\" frameborder=\"0\" title=\"Top NYC criminal summons type in 2015\"><\/iframe><\/div>\n<\/div>\n<\/div>\n<hr>\n<div class=\"row\">\n<div class=\"columns\">\n<h3>What were the results of these criminal summonses?<\/h3>\n<\/div>\n<div class=\"columns large-5\">\n<p>From 2003 to 2013, almost two thirds of cases were dismissed. Only 21% of people were found guilty, and the result was almost always a fine. Some neighborhoods are impacted more than others.<\/p>\n<p>Neighborhoods that have received the most criminal summonses per resident:<\/p>\n<ul style=\"-webkit-column-count: 2; -moz-column-count: 2; column-count: 2; list-style-position: inside;\">\n<li>Canarsie<\/li>\n<li>Brownsville<\/li>\n<li>Jamaica<\/li>\n<li>South Bronx<\/li>\n<li>East Harlem<\/li>\n<li>Mott Haven<\/li>\n<li>Port Morris<\/li>\n<li>Hunts Point<\/li>\n<\/ul>\n<p>Residents in low-income neighborhoods have been more likely to receive criminal summonses. In 2015, the top summons in each of these neighborhoods was Open Container of Alcohol.<\/p>\n<\/div>\n<div class=\"columns large-7\"><iframe loading=\"lazy\" src=\"https:\/\/nyc-council.cartodb.com\/viz\/fed64936-1e9f-11e6-b4c1-0ecfd53eb7d3\/embed_map\" name=\"cartodb-map\" width=\"100%\" height=\"400\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" title=\"Criminal Summonses Issued Per Capita by Police Precinct in 2015\"><\/iframe><\/div>\n<\/div>\n<hr>\n<h3>What is the Difference between Criminal and Civil Court Summonses?<\/h3>\n<div class=\"row\">\n<div class=\"columns large-6\">\n<h4>Criminal Court Summonses:<\/h4>\n<ul>\n<li>A person may receive a permanent criminal record for some criminal summonses.<\/li>\n<li>A criminal summons requires a personal court appearance in almost all cases.<\/li>\n<li>A warrant will be issued if a person does not appear in criminal court. The warrant rate in criminal court for these offenses is between 40% and 50%, resulting in over 1.5 million active summons warrants in the City.<\/li>\n<\/ul>\n<\/div>\n<div class=\"columns large-6\">\n<h4>Civil Court Summonses:<\/h4>\n<ul>\n<li>A person will not receive a permanent criminal record for civil summonses.<\/li>\n<li>Fines can be paid online and appearances can be made by phone.<\/li>\n<li>A warrant will not be issued if a person does not appear in civil court.<\/li>\n<li>The rate of fines being imposed in civil court is higher than criminal summons.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Council passed legislation in May 2016 to create more proportional penalties for certain low\u2011level, non\u2011violent offenses.
