New Yorkers can call the City\u2019s Call Center at 855-491-2667 or call 311 to facilitate claiming paid sick leave. For questions about how to obtain the necessary medical documentation, see the Health Department\u2019s\u00a0 FAQs:\u00a0<a href=\"https:\/\/www1.nyc.gov\/assets\/doh\/downloads\/pdf\/imm\/covid-19-paid-sick-leave-order-faq.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Frequently Asked Questions<\/a>.<\/p>\n<p><strong>Workers:&nbsp;<\/strong><a href=\"https:\/\/www1.nyc.gov\/site\/dca\/workers\/worker-rights.page\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Know your worker rights<\/a><\/p>\n<p><strong>Employers:<\/strong>&nbsp;You cannot retaliate against workers for exercising their right to safe and sick leave.&nbsp;<a href=\"https:\/\/www1.nyc.gov\/site\/dca\/businesses\/workplace-laws-for-employers.page\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Know your responsibilities<\/a>.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<h2 class=\"has-text-align-center wp-block-heading\">Emergency COVID-19 Paid Sick Leave <\/h2>\n<p>To address the immediate need of employees affected by COVID-19 who are subject to&nbsp;<strong>mandatory or precautionary orders of quarantine or isolation<\/strong>, the new law provides the following:<\/p>\n<p><strong>Employers with 10 or fewer employees<\/strong>&nbsp;and&nbsp;<strong>a net income less than $1 million<\/strong>&nbsp;will provide their workers:<\/p>\n<ul class=\"wp-block-list\">\n<li>Job protection for the duration of the quarantine order<\/li>\n<li>Guaranteed access to Paid Family Leave and disability benefits (short-term disability) for the period of quarantine including wage replacement for their salaries up to $150,000. Here&#8217;s how to&nbsp;<a href=\"https:\/\/paidfamilyleave.ny.gov\/COVID19\" target=\"_blank\" rel=\"noreferrer noopener\">apply for Paid Family Leave and disability benefits<\/a>.<\/li>\n<\/ul>\n<p><strong>Employers with 11-99 employees<\/strong>&nbsp;and employers with&nbsp;<strong>10 or fewer employees and a net income greater than $1 million<\/strong>&nbsp;will provide their workers:<\/p>\n<ul class=\"wp-block-list\">\n<li>At least 5 days of paid sick leave<\/li>\n<li>Job protection for the duration of the quarantine order<\/li>\n<li>Guaranteed access to Paid Family Leave and disability benefits (short-term disability) for the period of quarantine including wage replacement for their salaries up to $150,000. Here&#8217;s how to&nbsp;<a href=\"https:\/\/paidfamilyleave.ny.gov\/COVID19\" target=\"_blank\" rel=\"noreferrer noopener\">apply for Paid Family Leave and disability benefits<\/a>.<\/li>\n<\/ul>\n<p><strong>Employers with 100 or more employees<\/strong>, as well as all&nbsp;<strong>public employers<\/strong>&nbsp;(regardless of number of employees), will provide their workers:<\/p>\n<ul class=\"wp-block-list\">\n<li>At least 14 days of paid sick leave<\/li>\n<li>Guaranteed job protection for the duration of the quarantine order<\/li>\n<\/ul>\n<p>&nbsp;The provisions of the quarantine legislation took effect immediately upon the Governor&#8217;s signature, ensuring that New York workers are&nbsp;able to take advantage of these benefits now.<\/p>\n<p><strong>Additional Notes:<\/strong><\/p>\n<ul class=\"wp-block-list\">\n<li><strong>If you are quarantined but are working from home you do not qualify for these benefits.<\/strong><\/li>\n<li>You may be eligible for additional leave under&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/paidfamilyleave.ny.gov\/COVID19\" target=\"_blank\">NYS Paid Family Leave and disability benefits<\/a>. The Act provides enhanced Unemployment Insurance (UI) benefits and Pandemic Unemployment Assistance (PUA) for New Yorkers.<\/li>\n<li>The&nbsp;<a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www1.nyc.gov\/assets\/doh\/downloads\/pdf\/imm\/covid-19-unemployment-health-insurance.pdf\" target=\"_blank\">Unemployment Benefits and Health Insurance FAQ<\/a>&nbsp;also provides guidance for those recently unemployed due to COVID-19.<\/li>\n<li>The Department of Labor has released a new&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.youtube.com\/watch?v=XZ4QNYyg5dc\" target=\"_blank\">Public Service Announcement<\/a>&nbsp;(PSA) to help New Yorkers applying for&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/coronavirus.health.ny.gov\/system\/files\/documents\/2020\/04\/dol_unemploymentinsurancefaq_032720_0.pdf\" target=\"_blank\">unemployment benefits<\/a>.&nbsp;<\/li>\n<li>You are not required to demonstrate proof of searching for employment if you filed an unemployment claim;<\/li>\n<li><strong>Benefits available for New Yorkers<\/strong>&nbsp;&#8211; Here is a visual representation of eligibility for various government benefits called \u201cI\u2019ve been affected by Coronavirus (COVID-19). Cuomo&#8217;s Executive Order, the state will <a href=\"https:\/\/www.governor.ny.gov\/news\/during-coronavirus-briefing-governor-cuomo-announces-department-financial-services-will-require\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">waive<\/a> the 7-day waiting period for workers to claim unemployment insurance for those that have been put out of work by COVID-19.&nbsp; <\/p>\n<hr class=\"wp-block-separator\" \/>\n<p><strong><em>March 11, 2020<\/em><\/strong><\/p>\n<p>Governor Andrew M. Cuomo has <a href=\"https:\/\/www.governor.ny.gov\/news\/during-novel-coronavirus-briefing-governor-cuomo-announces-new-york-state-will-contract-28\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">announced<\/a> the state will guarantee two full weeks of paid leave for all state workers who are subject to a mandatory or precautionary order of quarantine as a result of the novel coronavirus. Employees will not have to charge accruals during the time taken off work for quarantine.
