{"id":216,"date":"2019-04-30T23:25:43","date_gmt":"2019-04-30T23:25:43","guid":{"rendered":"http:\/\/council.nyc.gov\/data\/?page_id=216"},"modified":"2020-06-09T12:43:49","modified_gmt":"2020-06-09T12:43:49","slug":"fix-the-system","status":"publish","type":"page","link":"https:\/\/council.nyc.gov\/data\/fix-the-system\/","title":{"rendered":"Fix the System"},"content":{"rendered":"<h3>Criminal Justice in the 21st Century<\/h3>\n<div class=\"row\">\n<div class=\"columns large-8\">\n<p>    Less than a decade ago, the New York City Police Department (NYPD) stopped and frisked almost <strong>700,000 <\/strong>people in a single year. The overwhelming majority of them were Black and Latinx New Yorkers who had <a href=\"https:\/\/www.nyclu.org\/en\/stop-and-frisk-data\">done nothing wrong<\/a>.<\/p>\n<p>In the 1990s, the City&#8217;s jail population was over <strong>20,000<\/strong>. Most of those people were charged with minor crimes and could not afford even a small amount of bail.<\/p>\n<p>And just 8 years ago, the justice system sent more than <strong>half a million<\/strong> people to criminal court for quality of life offenses. That\u2019s well over <strong>1,500<\/strong> criminal summonses every day.<\/p>\n<p>Today our stop and frisk rate is reportedly down by <strong>98%<\/strong>. Our jail population is almost a third of what it was. And criminal summonses for offenses like drinking in public are down <strong>96%<\/strong> from where they were less than a decade ago.<\/p>\n<p>We\u2019ve made great strides, but the profound injustices of those practices continue to haunt us.<\/p>\n<p>Our jail population in New York City right now is <strong>87%<\/strong> percent Black and Latinx. <strong>81%<\/strong> of people prosecuted for crimes in New York City are Black and Latinx. <strong>88%<\/strong> of those who are stopped and frisked are Black and Latinx.<\/p>\n<p>The policies of stop and frisk, broken windows, and mass incarceration have turned our criminal justice system into a system of injustice for poor people of color and had a profound and long-lasting impact.<\/p>\n<p>New York City is the safest big city in the country and we did this while <strong>moving away<\/strong> from these practices. This initiative will focus on men who need transitional housing&#8211;not jail&#8211;modeled after the women&#8217;s community justice project. The Speaker is calling for an investment in residential in-patient mental health programs.<\/p>\n<p><strong><a href=\"#equal-and-economic-justice\">Equal &amp; Economic Justice<\/a><\/strong><br \/>\nThe Council will fund a new courtroom in Brooklyn solely dedicated to assessing certain felony cases for alternatives to incarceration.<\/p>\n<p>The Council will call on the State Legislature to end mandatory surcharges and will pass legislation to establish a pilot to create a new fine structure for certain civil offenses.<\/p>\n<\/div>\n<div class=\"columns large-4\">\n<p><strong><a href=\"#justice-for-driving-offenses\"> Justice for Driving Offenses<\/a><\/strong><br \/>\nThe Council will be negotiating policy with the administration that will move cases involving a suspended driver&#8217;s license to the DMV court instead of criminal court.<\/p>\n<p><strong><a href=\"#justice-for-persons-in-sex-trade\">Justice for Persons Involved in the Sex Trade<\/a><\/strong><br \/>\nThe Council will pass a resolution in support of repealing the State law related to loitering for the purpose of prostitution. The Council will also fund the creation of a comprehensive wraparound support center for those who are engaging in survival sex or have been trafficked.<\/p>\n<p><strong><a href=\"#collateral-consequences\">Collateral Consequences<\/a><\/strong><br \/>\nThe Council will pass a law requiring an audit of all city agencies to examine their practices and identify points where drug convictions in the denial of services or any other negative consequences. The Council will examine which of these policies make sense and which prevent people from moving on with their lives.<\/p>\n<\/div>\n<\/div>\n<hr>\n<div class=\"row\">\n<div class=\"columns large-6\">\n<h3>Police Actions<\/h3>\n<p>There are several types of police actions in NYC:<\/p>\n<p>A <strong>violation<\/strong>, like drinking in public or disorderly conduct, is not considered a crime. In most cases you can pay a fine or do community service.<\/p>\n<p>A <strong>misdemeanor<\/strong> is more serious than a violation, but not as serious as a felony. There are two classes of misdemeanors.<\/p>\n<p><strong>Felonies<\/strong> are the most serious crimes, like murder, rape and arson. If you are found guilty of a felony, you may be sent to jail for at least 1 year. There are several <a href=\"http:\/\/ypdcrime.com\/penal.law\/offense_level.htm\">classes<\/a> of felonies. Felonies are also categorized as either violent or non-violent.<\/p>\n<p><a href=\"https:\/\/data.cityofnewyork.us\/Public-Safety\/NYPD-Arrests-Data-Historic-\/8h9b-rp9u\">Historical<\/a> and <a href=\"https:\/\/data.cityofnewyork.us\/Public-Safety\/NYPD-Arrest-Data-Year-to-Date-\/uip8-fykc\">2018<\/a> NYPD arrest (felony, misdemeanor and violations) data can be found on the open data portal.<\/p>\n<\/div>\n<div class=\"columns large-6\">\n    &nbsp;<br \/>\n&nbsp;<br \/>\n&nbsp;<\/p>\n<p><strong>Stop, question &amp; frisk<\/strong> is a NYPD <a href=\"https:\/\/www1.nyc.gov\/site\/ccrb\/investigations\/stop-question-and-frisk.page\">action<\/a> of temporarily stopping, questioning, and searching persons. The NYPD has made available <a href=\"https:\/\/www1.nyc.gov\/site\/nypd\/stats\/reports-analysis\/stopfrisk.page\"> stop &amp; frisk data <\/a>from 2003 to 2018.<\/p>\n<p><strong>Criminal Summons<\/strong> or &#8216;pink tickets&#8217; are issued by NYPD officers and other law enforcement jurisdictions. People that receive <a href=\"http:\/\/www.mysummons.nyc\/faqs.shtml\">summons<\/a> are usually not arrested or fingerprinted. Most current <a href=\"https:\/\/data.cityofnewyork.us\/Public-Safety\/NYPD-Criminal-Court-Summons-Incident-Level-Data-Ye\/mv4k-y93f\/data\">year<\/a> and <a href=\"https:\/\/data.cityofnewyork.us\/Public-Safety\/NYPD-Criminal-Court-Summons-Historic-\/sv2w-rv3k\">historical<\/a> summons data can be found on the open data portal.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n  &nbsp;<br \/>\n&nbsp;<\/p>\n<div class=\"columns large-8\">\n<div style=\"text-align: center\">\n<h4 class=\"header-tiny\">Police Actions<br \/>\n<small>2006-2018<\/small><\/h4>\n<div class=\"flex-video\" style=\"padding-bottom: 60%;\"><iframe loading=\"lazy\" title=\"Police Action Over Time\" src=\"https:\/\/newyorkcitycouncil.github.io\/datavis\/templates\/multilinechart1.html\" width=\"600\" height=\"550\" frameborder=\"0\" align=\"right\"><\/iframe><\/div>\n<\/div>\n<\/div>\n<div class=\"columns large-4\">\n      &nbsp;<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\n&nbsp;<\/p>\n<p>Of the police actions in the chart, <strong>stop and frisk incidents<\/strong> have had the <strong>greatest decline<\/strong> since 2011.<\/p>\n<p>Arrests for misdemeanors and criminal summonses have also declined but at a slower pace, while arrests for felonies have decreased slightly.<\/p>\n<p>Violations have been quite steady over time. But in 2016, violations have slightly dipped.<\/p>\n<\/div>\n<\/div>\n<hr>\n<h3>Racial Disparities<\/h3>\n<div class=\"row\">\n<div class=\"columns large-8\">\n<h4 class=\"header-tiny\">Stop, Question &amp; Frisk<\/h4>\n<p><small>Total Incidents, 2010-2018<\/small><\/p>\n<div class=\"flex-video\" style=\"padding-bottom: 60%;\"><iframe title=\"Stop, Question &amp; Frisk Incidents Over Time\" src=\"https:\/\/newyorkcitycouncil.github.io\/datavis\/templates\/linechart3.html\" frameborder=\"0\"><\/iframe><\/div>\n<\/div>\n<div class=\"columns large-4\">\n&nbsp;<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\n&nbsp;<br \/>\nOver time, stop and frisk incidents have decreased significantly, but racial disparities persist year after year.<\/p>\n<p>The <strong>peak<\/strong> of stop, question and frisk was in 2011 with about 685,000 incidents, averaging over <strong>1,850 occurrences each day<\/strong>.<\/p>\n<p>When comparing that peak to the most recent year, 2018, there is a <strong>98% decrease<\/strong> in stops.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\"columns large-4\">\n<div class=\"show-for-large\" style=\"padding-top: 0rem; While white men make <strong>close to 35%<\/strong> of the City&#8217;s population, they represent <strong>only 12%<\/strong> of male arrests.<\/p>\n<p>Adult males make up 80% of the 2018 arrested population. White men have a rate of <strong>2%<\/strong>.<\/div>\n<\/div>\n<hr>\n<div class=\"row\">\n<div class=\"columns large-12\">\n<h4 class=\"header-tiny\">Arrests for Driving with a Suspended License, 2018<\/h4>\n<p>When looking at driving offenses, specifically arrests for driving with a suspended license (<a href=\"http:\/\/ypdcrime.com\/vt\/vehicle-traffic-section511.htm\">Vehicle Traffic Law 511<\/a>),<br \/>\n<strong>80%<\/strong> of those arrested in 2018 were <strong>black or latinx<\/strong>.<\/p>\n<div class=\"flex-video\" style=\"padding-bottom: 50%;\"><iframe loading=\"lazy\" src=\"https:\/\/nyc-council.carto.com\/builder\/69c8a1ee-2e07-4eb1-a074-16bc596666af\/embed\" width=\"95%\" height=\"220\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<\/div>\n<\/div>\n<\/div>\n<hr>\n<h3 id=\"rebuild-trust\">Rebuilding Trust<\/h3>\n<div class=\"row\">\n<div class=\"columns large-6\">\n<h5>Repeal 50-a<\/h5>\n<p>The State Legislature needs to repeal 50-a, the <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/CVR\/50-A\">state law<\/a> that allows the NYPD to shield police officers from public scrutiny. 50-a keeps officer misconduct in the shadows.<\/p>\n<p>It\u2019s what kept New Yorkers from knowing the disciplinary records of officers involved in the death of Eric Garner. He died in 2014 and five years later, the public still has many unanswered questions.<\/p>\n<h5>#CloseRikers<\/h5>\n<p>Going forward, our default response to most arrests should be diversion, treatment, and rehabilitation \u2013 not incarceration.<\/p>\n<p>This is why the City is <a href=\"https:\/\/rikers.cityofnewyork.us\/nyc-borough-based-jails\/\">closing Rikers Island<\/a>. The land use process for new jail sites has begun, and Albany has finally <a href=\"https:\/\/www.governor.ny.gov\/news\/governor-cuomo-announces-highlights-fy-2020-budget\">passed transformative laws<\/a> on the issues of discovery, speedy trial, and bail reform.<\/p>\n<\/div>\n<div class=\"columns large-6\">\n<h5>Diversion, Treatment, and Rehabilitation<\/h5>\n<p>The City needs to increase the investment in alternatives to jail and prison.<\/p>\n<p>The City can do this by taking the money spent on the City&#8217;s jails and investing those funds in the communities directly impacted by mass incarceration.<\/p>\n<p>The City must address the fundamental problems that led to the justice system&#8217;s involvement in these communities in the first place.<\/p>\n<p><img decoding=\"async\" src=\"http:\/\/council.nyc.gov\/data\/wp-content\/uploads\/sites\/73\/2019\/05\/ElDoario-CommunityPolicing.jpg\"><\/p>\n<\/div>\n<\/div>\n<hr>\n<h3 id=\"mental-health-and-jail\">Mental Health &amp; Jail<\/h3>\n<div class=\"row\">\n<div class=\"columns large-6\">Nearly one in five people in our city jails have been diagnosed with a serious mental illness.<\/p>\n<p>Most come from poor communities of color that have limited access to medical care, and are also subject to higher levels of law enforcement.<\/p>\n<p>The health care system has turned away the chronically ill, leaving jails as the public caretaker of last resort.<\/p>\n<p>But incarcerating people with mental health issues is a profound injustice, and something should never happen in our city.<\/p>\n<p>The City Council will <strong>fund a program<\/strong> to connect social workers with defense attorneys and medical staff early on in a case to find alternatives to incarceration.  The Speaker will introduce the <strong>Get Well &amp; Get Out Act<\/strong> that will require correctional health services to communicate critical information about a person&#8217;s mental health status to their attorneys.<\/p>\n<\/div>\n<div class=\"columns large-6\"><img decoding=\"async\" src=\"http:\/\/council.nyc.gov\/data\/wp-content\/uploads\/sites\/73\/2019\/05\/Mental-Health.png\"><\/div>\n<\/div>\n<hr>\n<div class=\"row\">\n<div class=\"columns large-6\">\n<h3 id=\"equal-and-economic-justice\">Economic Justice: Surcharges<\/h3>\n<p>In 1982, as part of a <strong>misguided effort<\/strong> to be \u201ctough on crime,\u201d our state added mandatory court \u201csurcharges\u201d to all convictions.<\/p>\n<p>These surcharges run from $120 for a non-criminal offense to $250 for a misdemeanor. And almost $400 for a felony. For those with means, $120 is a nuisance. But for those living in poverty, $120 is a severe hardship.<\/p>\n<p>The Council <strong>will call on <\/strong>the state to end mandatory surcharges. The poor are already overly burdened by our criminal justice system. Forcing them into a system that has discriminated against them for decades \u2013 and then charging them for it \u2013 is an injustice.<\/p>\n<\/div>\n<div class=\"columns large-6\"><img decoding=\"async\" src=\"http:\/\/council.nyc.gov\/data\/wp-content\/uploads\/sites\/73\/2019\/05\/Surcharges.png\"><\/p>\n<\/div>\n<\/div>\n<h3 style=\"margin-top:20px\">Economic Fairness: Civil Fines<\/h3>\n<div class=\"row\">\n<div class=\"columns large-7\">\n<p>The City needs to address how fines are set on certain civil offenses. Much like court fees, these fines have a disproportionate impact on the poor.<\/p>\n<p>The Council is proposing to <strong>pilot a new fine structure<\/strong> for certain civil offenses &#8211; one that is tied to a person\u2019s means with the help of the City\u2019s Office of Administrative Trials and Hearings (OATH).<\/p>\n<p>This concept, commonly known as <strong>\u201cday fines<\/strong>,\u201d is simple: fines are based on a certain percentage of a person\u2019s daily income.<\/p>\n<\/div>\n<div class=\"columns large-5\"><img decoding=\"async\" src=\"http:\/\/council.nyc.gov\/data\/wp-content\/uploads\/sites\/73\/2019\/05\/day-fines.png\"><\/div>\n<\/div>\n<hr>\n<h3 id=\"justice-for-driving-offenses\">Justice for Driving Offenses<\/h3>\n<div class=\"row\">\n<div class=\"columns large-4\">The fourth most charged crime in our city is driving with a suspended license. Well over 15,000 people every year are fingerprinted, booked, and charged with this &#8220;crime&#8221;.<\/p>\n<p>The<strong>\u201ccrime\u201d <\/strong>in most of these cases is the failure to pay a moving violation.<\/p>\n<p>Everyone should pay their fines for moving violations, however the punishment should not be criminal charges or incarceration.<\/p>\n<p>This is why the Council will negotiate a policy with the administration that will move cases involving a suspended driver\u2019s license to the DMV court instead of criminal court.<\/p>\n<p>76% of the drivers in our City are white, but 80% of the people arrested for driving with a suspended license in 2018 are Black or Latinx.<\/p>\n<\/div>\n<div class=\"columns large-8\">The <strong>fourth<\/strong> most court arraigned crime charge in the city in 2018 was <strong>driving with a suspended license.<\/strong><\/p>\n<div class=\"flex-video\" style=\"padding-bottom: 70%;\"><iframe title=\"Percentage of Total Court Arraignment Charges\" src=\"https:\/\/newyorkcitycouncil.github.io\/datavis\/templates\/barhorizontal31.html\" frameborder=\"0\"><\/iframe><\/div>\n<\/div>\n<\/div>\n<hr>\n<div class=\"row\">\n<div class=\"columns large-6\">\n<h3 id=\"justice-for-persons-in-sex-trade\">Justice for Persons Involved in the Sex Trade<\/h3>\n<p>What you choose to wear should never be an indicator of criminality.<\/p>\n<p>Yet that\u2019s exactly what the state does with its archaic and wrongheaded law that penalizes what is allegedly loitering for the purposes of prostitution.<\/p>\n<p>This means that the police monitor the way people dress under the guise that certain clothes make you \u201clook\u201d like you\u2019re selling sex.<\/p>\n<p>Arrests for this offense disproportionately target transgender women and women of color.<\/p>\n<p>The number of these loitering arrests <strong>more than doubled <\/strong>between 2017 and 2018. This is blatant misogyny. This law must be repealed immediately.<\/p>\n<\/div>\n<div class=\"columns large-6\"><img decoding=\"async\" src=\"http:\/\/council.nyc.gov\/data\/wp-content\/uploads\/sites\/73\/2019\/05\/image1.png\"><\/div>\n<\/div>\n<hr>\n<div class=\"row\">\n<div class=\"columns large-12\">\n<h3 id=\"collateral-consequences\">Collateral Consequences &amp; Substance Abuse<\/h3>\n<\/div>\n<div class=\"columns large-4\">\nIt is now a well-established fact that a summons, arrest, or criminal conviction has consequences that could follow a person for life.<\/p>\n<p>The City Council has already addressed this issue in numerous ways, including passing the <a href=\"https:\/\/legistar.council.nyc.gov\/LegislationDetail.aspx?ID=1739365&amp;GUID=EF70B69C-074A-4B8E-9D36-187C76BB1098\">\u201cBan the Box\u201d legislation<\/a> to reduce the impact of a criminal conviction on employment.<\/p>\n<p>Last month, the Council <a href=\"https:\/\/legistar.council.nyc.gov\/LegislationDetail.aspx?ID=3860393&amp;GUID=7040463F-8170-471C-97EC-A61AE7B1AA2F&amp;Options=&amp;Search=\">passed legislation<\/a><br \/>\nbanning pre-employment drug testing for marijuana, ending a significant barrier to employment.<\/p>\n<p>The City will take a hard look at our own policies that affect those with criminal convictions, particularly those with drug convictions, to identify policies that may be overly punitive.<\/p>\n<\/div>\n<div class=\"columns large-4\">\n<img decoding=\"async\" src=\"http:\/\/council.nyc.gov\/data\/wp-content\/uploads\/sites\/73\/2019\/05\/MarijuanaArrests.png\"><\/div>\n<div class=\"columns large-4\">\nThe Speaker supports the full legalization of marijuana and has been advocating for the State to end this criminalization once and for all.<\/p>\n<p>The reality is that the use of marijuana has already been legal in this city \u2013 if you\u2019re white.
