{"id":1470,"date":"2021-01-08T22:23:46","date_gmt":"2021-01-08T22:23:46","guid":{"rendered":"http:\/\/council.nyc.gov\/data\/?page_id=1470"},"modified":"2023-01-31T18:45:10","modified_gmt":"2023-01-31T18:45:10","slug":"evictions-covid","status":"publish","type":"page","link":"https:\/\/council.nyc.gov\/data\/evictions-covid\/","title":{"rendered":"Preparation for the End of the Eviction Moratoriums"},"content":{"rendered":"<h2>Evictions During the COVID-19 Pandemic<\/h2>\n<div class=\"row\">\n<div class=\"columns large-5\">\n    Thousands of renters in New York City currently are protected by the State moratorium or CDC guidance to halt evictions are facing the impending end of the moratorium on May 1, 2021.<\/p>\n<p>The National Low Income Housing Coalition estimates that over 30 million Americans may be at risk of losing their homes in the new year if no new action is taken.<\/p>\n<p>In New York City, many renters were already in a precarious position prior to the pandemic, with many low-income households putting a significant portion of their income towards their rent and lack sufficient savings or emergency funds to carry them through missed work or lost wages.<\/p>\n<\/div>\n<div class=\"columns large-4\">\n    There are currently 14,000 active eviction warrants posed to move forward following the lifting of the moratorium. Jan 2021<\/small><\/h4>\n<div class=\"flex-video\" style=\"padding-bottom:50%;\">\n                            <iframe loading=\"lazy\" src=\"https:\/\/newyorkcitycouncil.github.io\/RTC_Evaluation\/images\/oca_bymodzcta.html\" title=\"Evictions Filings during COVID-19 Pandemic\" allowfullscreen=\"\" width=\"1600\" height=\"900\" frameborder=\"0\"><\/iframe><\/div>\n<p align=\"right\"><small><a href=\"https:\/\/github.com\/austensen\/oca\">Data Source: NYC Housing Court Filings<\/a><\/small><\/p>\n<\/div>\n<\/div>\n<\/div>\n<hr>\n<div class=\"row\">\n<div class=\"columns large-6\">\n<h3>Tenant Harassment<\/h3>\n<p>In 2017, New York City had a <a href=\"https:\/\/www1.nyc.gov\/assets\/hpd\/downloads\/pdf\/about\/2017-hvs-initial-findings.pdf\">vacancy rate of 3.63 %<\/a>, which has led to a continuation of the decades-long declaration of a housing emergency in our City.<\/p>\n<p>Unfortunately, there is concern that landlords may be bringing frivolous eviction lawsuits in order to create more vacant apartments.<\/p>\n<p>This is particularly true where the tenant resides in a rent-regulated apartment and has actually paid rent or intentionally withheld rent because the landlord failed to make necessary repairs.<\/p>\n<p>Landlords sometimes use construction to remove tenants by doing renovations in occupied buildings, <a href=\"https:\/\/www.nytimes.com\/2014\/02\/25\/nyregion\/in-new-york-push-for-market-rate-housing-pits-landlords-against-tenants.html\">creating hazards<\/a> to make apartments uninhabitable, and forcing tenants to choose between protecting their health and staying in their homes. Eviction actions may be brought against tenants for various reasons, including non-payment of rent, or inappropriate tenant conduct.\n\n                              <strong>HPD Violations (Hazardous-Class C)<\/strong>: These are the most hazardous violations issued by the Department of Housing Preservation and Development, which enforces the Housing Maintenance Code and Multiple Dwelling Law.\n\n                              <strong>OATH\/ECB Violations (Hazardous-Class 1)<\/strong>: These are the most hazardous violations issued by the Department of Buildings, which enforces the Construction Codes and the Zoning Resolution.\n\n                              <strong>311 Service Requests (Heat &amp; Hot Water)<\/strong>: Building owners are required to provide heat during heat season, which is between October 1 and May 31, as follows: Between 6AM and 10PM, if the outside temperature is below 55 degrees, the inside temperature must be at least 68 degrees, and between 10PM and 6AM, the inside temperature must be at least 62 degrees, regardless of the outside temperature.<\/div>\n\n\n\n\n<div class=\"columns large-6\">\n                            &nbsp;\n                            &nbsp;\n                            <strong>Regulation (Subsidies or Rent Stabilization)<\/strong>: Tenants in all rent-regulated housing are guaranteed the right to stay in their homes unless the State agency that oversees rent-regulation, Homes and Community Renewal, approves a landlord\u2019s application to refuse renewal of a lease or to proceed with an eviction.
