Fiscal Year 2011 Budget
In addition to its role as the New York City’s legislative body, the Council works closely with the Mayor each year to develop and approve the city’s annual budget. To ensure that the budget that is passed reflects New Yorkers’ needs and priorities, the Council conducts an in-depth review of all city agencies, their policies, their programs and their expenses. The Council is working hard to ensure that the process is as transparent and accountable as possible.

Expense Budget Modifications
The Council annually adopts the City’s budget covering expenditures other than for capital projects (the “Expense Budget”) pursuant to Section 254 of the Charter. Generally, Budget Modifications, which are initiated by the Mayor and voted on by the Council pursuant to section 107(b) of the City Charter., reallocates appropriations that were reflected in the Expense Budget.

Terms and conditions impose requirements on units of appropriation in either the expense budget or the capital budget. These requirements often consist of reporting on indicators related to the progress of spending the appropriated funds, or certain programmatic aspects of the spending. In most years, as part of the budget negotiation process, the City Council proposes terms and conditions to be included in the adopted budget.

No later than April 1, 2011, as a condition of the funds in units of appropriation 102 and 112, the Commissioner of the Department of Health and Mental Hygiene (DOHMH) shall submit to the Council a report detailing the wait times for services sought in DOHMH’s clinics. The report shall provide the average wait times of services sought, disaggregated by service type, for each DOHMH clinic. Report.
As a condition of the funds in unit of appropriation numbers 107 and 117, the Commissioner of the Department of Health and Mental Hygiene (DOHMH) shall provide to the City Council and make available on DOHMH’s website, no later than December 31, 2010, an Oral Health Resource page that will include information on finding providers, including those that serve individuals enrolled in public health insurance programs, and oral health education resources.
As a condition of the funds in unit of appropriation numbers 102 and 112, the Commissioner of the Department of Health and Mental Hygiene (DOHMH) shall develop guidelines for schools regarding diseases reportable to the Bureau of Communicable Disease, no later than December 31, 2010. Such guidelines shall include education regarding such diseases, prevention methods and protocols for responding to incidents of such diseases in a particular school.

Preliminary Budget Response
Pursuant to section 247 of the New York City Charter, the City Council is required to hold hearings on the program objectives and fiscal implications of the Mayor’s Preliminary Budget. Testimony received at these hearings aid the Council in providing a written response to the Mayor’s Preliminary Budget. Such response generally details findings and recommendations of the Council for any changes the Council would like the Mayor to consider in preparing the Executive Budget.
As per our Charter mandate, the Council held numerous hearings on the FY11 preliminary budget that included over a hundred hours of testimony. The Council heard from 63 agencies and well over 200 members of the public during 3 weeks of committee hearings. This year’s budget response details many of the concerns expressed by agency commissioners, Council Members and average New Yorkers during the FY11 preliminary budget hearings.
